21 tion GIKIIID V in Respondents failed to acknowledge the claim's exis-
22 tance and thus did not address the claims merits or lack thereof. The re-
23 cord supports the existance of the claim, as followszz Motion for Leave to
‘ 24 Amend, filed July 19, 2005: Dbtion for Clarification, filed August 9, 2005;
25 Motion to Dismiss Unexlfausted Claims, filed August 9, 2005, and petitioner's
26 1 st. Amended Petition. All of which contradicts Respondents reasoning in
27 their Answer to Petition for Writ of Ha& Corpus, filed August 11, 2005.
28 Petitioner is without counsel or guidance on this matter and therefore relies
