2005 directing Plaintiff to file a Response to a Motion For Summary Judgement
filed by Defendant Richard Smelser on June l4,2005.("Motion")
Plaintiff did not receive a copy of the Motion until September 23.2005.
Plaintiff additionally, filed a Motion For Enlargement Of Time to Respond to
the Motion with the Court. Plaintiff never received a filed copy of the Motion
For Enlargement Of Time and Contrues this to mean. the Court did not receive
the Motion For Enlargement Of Time to File a Response to Defendant Richard
Smelser's Motion For Summary Judgement.
Plaintiff now seeks an Enlargement Of Time to Respond to the Motion,
and brings the hereby Motion For Enlargement Of Time to Respond to the Motion
pursuant to Fed. R. Civ. P. Rule 6(bJ and is being supported by the attached
Declaration of Plaintiff.
