Plaintiff] Michael K. Smith herein, Pro Se, hereby moves the Court for dismissal, without
prejudice, of the above-entitled action, on the grounds that the claims and issues in this action are
identical to those presented in a previously dismissed action by Michael Keith Smith in the United
States District Court, for the District of Phoenix, Arizona. In CVO3—2393-PHX-PGR, a declaratory
judgment was dismissed without prejudice on July 23, 2004, ". . .until such time Plaintiif conviction or
sentence has been reversed on direct appeal, that it has been called into question by a federal court’s
issuance of a writ of habeas corpus under 28 U.S.C. § 2254, or that it has been expunged or declared
inva1id.” Presently pending is Plaintiffs (Petitioner's) writ of habeas corpus before the United States
District Court, Phoenix,
