IT IS ORDERED striking Plaintiff's Motions in Limine [docs. 180, 209 and 219] as the filing of said motions was not authorized by this Court as discussed at the Scheduling Conference on September 30, 2004. The Court notes the Joint Proposed Pretrial Order was not signed by either counsel. Discussion held. IT IS ORDERED directing counsel to confer and submit a new Joint Proposed Pretrial Order signed by both counsel no later than 5:00 p.m., July 10, 2006. Pending motions discussed. For reasons as stated on the record, the Court rules as follows: denying Plaintiff's Motion for Leave to File Sur-reply [doc. 216]; denying Plaintiff's Motion for Disqualifying Defendants' Expert John Trotto [doc. 163]; denying Defendants' Motion to Preclude Testimony of Plaintiff's Expert Richard Weisgrau [doc. 184]; granting Defendants' Motion to Preclude Testimony of Plaintiff's Expert Jeff Sedlik [doc. 208]; granting Defendants' Motion to Withdraw Admission and to Enter Denials [doc. 191]. The Court advises counsel it is unavailable on July 11, 2006, to conduct trial but can proceed with trial on July 18, 2006. Discussion held. Upon agreement of counsel, IT IS ORDERED continuing Bench Trial from July 11, 2006, to July 18, 2006, at 9:00 a.m. Estimated trial length: 4 to 5 days. Discussion held re: witness Bob Hackett At the request of defense counsel, said witness may appear either by telephone or video teleconference. A copy of the exhibit marking instructions is provided to counsel this date.
