3/14/2006 Avnet disclosure: "Avnet.com - This photograph was used between February 5, 2004 and February 25, 2004 on the homepage of Avnet.com for public relations. Between August 28, 2002 and February 25, 2004 the picture of Vallee appeared on a secondary page of the website for public relations." However - in "Avnet's Answers to Plaintiff's Request for Admissions," Avnet admits they used one of Coogan's images on the home page in 2002 and 2003. (see "Avnet's Response to Plaintiff's Third Request for Admissions to Defendant Avnet, Inc.," - Admissions 15, 33, 37, and 43). Avnet's own admissions (Sworn 12/5/05, Dated 12/6/05): · 15 - "that at the time that YOU won at least one Stevie Award concerning YOUR website, the home page of www.avnet.com carried at least one of PLAINTIFF'S PHOTOGRAPHS" · 33 - "that the Stevie Award YOU won concerning YOUR website covered the Avnet website for 2003" · 37 - "that during the time the Avnet website provided "Avnet.com visitors with more comprehensive, helpful information than many other corporate sites, including expanded Investor Relations content and the addition of Press Room and Quality sections", at least one of PLAINTIFF'S PHOTOGRAPHS was on the home page of Avnet's website" · 43 - "that in 2002 Avnet.com (http://www.avnet.com) bore at least one of PLAINTIFF'S PHOTOGRAPHS directly on the home page for this website" Case 2:04-cv-00621-SRB Document 248-5 Filed 06/28/2006 Page 8 of 15
