Petitioner, a state prisoner proceeding pro se, filed a complaint concerning the conditions of his confinement at the California Correctional Institution in Tehachapi, California, where he is currently incarcerated. Petitioner filed his complaint on the court's form for a petition for a writ of habeas corpus pursuant to 28 U.S.C. § 2254. Because the acts complained of occurred in Kern County, which lies within the venue of the Eastern District of California, venue properly lies in the Eastern District. See 28 U.S.C. § 1391(b). Accordingly, this case is TRANSFERRED to the United States District Court for the Eastern District of California. See 28 U.S.C. § 1406(a). In view of the transfer, the court will not determine whether to construe the instant petition as a civil rights complaint pursuant to 42 U.S.C. § 1983.
