USA, CV 07-2611 ABC (RCx) (C.D. Cal. entered Sept. 21, 2007), attached hereto as Exhibit C. In these Orders, Judge Klausner, Judge Feess, and Judge Collins dismissed, with prejudice and without leave to amend, three separate actions filed in the Central District based on claims that are similar to the claims that Plaintiff asserts in this action. Kraft respectfully submits that the Court's analysis and disposition in these three cases are relevant to the arguments raised in Kraft's Motion to Dismiss. It is proper on a Rule 12(b)(6) motion to dismiss for a court to take judicial notice of another court's opinion "for the existence of the opinion, which is not subject to reasonable dispute over its authenticity." Lee v. City of Los Angeles, 250 F.3d 668, 690 (9th Cir. 2001). The decisions and orders of a district court may be judicially noticed, as they are public records which are "capable of accurate and ready determination by resort to sources whose accuracy cannot reasonably be questioned." Fed. R. Evid. 201(b); see Marsh v. San Diego County, 432 F. Supp. 2d 1035, 1043 (S.D. Cal. 2006) ("A court may take judicial notice of the existence of matters of public record, such as a prior order or decision[.]"); Wible v. Aetna Life Ins. Co., 375 F. Supp. 2d 956, 965 (C.D. Cal. 2005) ("This court may take judicial notice of its own records, and documents that are public records and capable of accurate and ready determination by sources that cannot reasonably be questioned."); see also United States v. Wilson, 631 F.2d 118, 119 (9th Cir. 1980) ("In particular, a court may take judicial notice of its own records in other cases, as well as the records of an inferior court in other cases."); Perry v. The Upper Deck Co., LLC, Case No. 05 CV 1329 LAB (CAB), 2007 WL 1449797, at *2 (S.D. Cal. Cal. 2004) (taking judicial notice of "the opinions, complaints, briefs, and evidence filed in other actions" in order to "review how other courts have addressed" the "arguments and contentions" raised in the controversy before it); Wendt v. Smith, 273 F. Supp. 2d 1078, 1082 (C.D. Cal. 2003) (taking judicial notice of "various opinions of the U.S. District Courts and unpublished opinions of the Ninth Circuit"); Gardiner v.
