COURTROOM MINUTES/MINUTE ORDER PRELIMINARY SCHEDULING/STATUS CONFERENCE Court in session: Court calls case. Appearances of pro se Plaintiff and counsel. The Court notes that Plaintiff did not participate in the preparation of the proposed Scheduling Order; and the Court, counsel and Plaintiff discuss that issue. Discussion regarding the Court' order of July 12, 2005, imposing sanctions against s Plaintiff in the amount of $135 and Plaintiff' ability to pay that amount. Plaintiff orally s moves for additional time to pay the sanction. ORDERED: Plaintiff' oral motion for extension of time to pay the sanction imposed s against him on July 12, 2005, in the amount of $135 is GRANTED. Plaintiff shall have to and including October 3, 2005, to pay the sanction of $135 to counsel for Defendants. Plaintiff has stated on the record that he withdraws his objection to the sanction filed August 10, 2005, and the Court deems the objection withdrawn. 9:57 a.m.

Discussion regarding Plaintiff' ability to pay the filing fee and the plaintiff' current s s mailing address. The Court notes that mail is consistently returned as undeliverable from the address provided by Plaintiff. Plaintiff states that he does not want his current address to be made public. Plaintiff is again advised that it is his responsibility to maintain a current address with the Court. ORDERED: Plaintiff shall have to and including August 23, 2005, to provide his information for the preparation of the proposed Scheduling Order to the Court. Any witness list submitted by Plaintiff must contain names, addresses, and telephone numbers of the witnesses he intends to call.
