Court reviews proposed pretrial order and counsel answer questions. Discussion regarding witnesses, affirmative defenses, exhibits and scheduling. Mr. Atkinson states defendant is still asserting all affirmative defenses and invalidity claims. Counsel agree to the admissibility of Terry Lier's two written letter opinions and e-mails. He will not be called as a witness. Mr. Atkinson further states defendant does not have a damages expert. Court states it will determines issues regarding preliminary injunction and inequitable conduct after a separate hearing, if necessary. Court further states previous preliminary injunction and federal circuit rulings will not be disclosed to the jury. Counsel agree to show jury the FJC Introduction to Patent System DVD. No jury questionnaire. Exhibits that have not been previously disclosed are not permitted.

Simultaneous trial briefs including claim construction chart are to be filed by August 15, 2008. Rebuttal briefs are to be filed by September 12, 2008. Proposed jury instructions, verdict form and voir dire are to be submitted by 4:00 p.m. October 10, 2008. Two week jury trial scheduled October 27, 2008. Objections to videotape deposition transcript designations are to be submitted by October 10, 2008. Court in recess.
