("Quovadx"), by its undersigned counsel, hereby states that it does not oppose the entry of partial summary judgment on its liability under Section 11 of the Securities Act of 1933, 15 U.S.C. § 77k, as requested in lead plaintiffs' Motion for Partial Summary Judgment as to Liability, filed December 1, 2005. Nothing herein should be construed as an admission by Quovadx regarding the separate issue of damages. Quovadx reserves its right to seek summary judgment and/or present evidence at trial regarding the proper measure and amount of damages in this case.
