Defendants, by their undersigned counsel, hereby state that they do not oppose the voluntary dismissal of all claims asserted in this action against defendants Jeffrey M. Krauss, Fred L. Brown, J. Andrew Cowherd, James B. Hoover, Charles J. Roesslein, James A. Gilbert, Lorine R. Sweeney and Gary T. Scherping (collectively, the "Individual Defendants"), as requested in plaintiffs' Motion for Voluntary Dismissal, filed on December 23, 2005. While they do not oppose the dismissal of all claims against the Individual Defendants, Defendants do not agree with plaintiffs concerning the question of notice to the class of the voluntary dismissal of the claims against the Individual Defendants. Defendants respectfully request that the Court dismiss all claims against the Individual Defendants, and reserve for consideration at the scheduling conference set for February 9, 2006, or otherwise, all questions concerning notice to the class.
