As Quovadx, Inc. has agreed to the entry of summary judgment against it, and in light of Lead Plaintiff Special Situations Fund III, L.P.; Special Situations Cayman Fund, L.P.; Special Situations Technology Fund New, L.P.; and Special Situations Technology Fund II, L.P. (collectively "Special Situations" or "Lead Plaintiff")'s Motion for Voluntary Dismissal of the Individual Defendants, the Lead Plaintiff withdraws that portion of its Motion for Partial Summary Judgment filed December 1, 2005 (the "Motion for Summary Judgment") with respect to Jeffrey M. Krauss, Fred L. Brown, J. Andrew Cowherd, James B. Hoover, Charles J. Roesslein, James A. Gilbert, Lorine R. Sweeney and Gary T. Scherping (the "Individual Defendants"), without prejudice.
