I tell you that all parties are equal before the law to remind you that you must base your decision in this trial on the evidence presented to you, the facts, and the law upon which I have instructed you. The race, national origin, or ethnicity of a party is not something that you may consider or take into account. The fact that Plaintiff is a former public employee gives him certain rights that he would not have if he were a private employee, but you should not decide in his favor, or against him, just because he is a former public employee. The fact that the Defendant is a public entity subjects it to certain duties or obligations that private persons or organizations may not have, but you must not decide in its favor, or against it, just because it is a public entity. All persons, whether individuals such as Mr. Cadorna or municipalities such as the City of Denver, stand equal before the law, and are to be dealt with as equals in the court of justice.
