ORDERED: Judgment will enter and costs will be awarded to Plaintiff. Court' comments s The jury found a contract, not only found it, but found breach and damages. The law of promissory estoppel is applicable only in the absence of an otherwise enforceable contract. So pending any appeal, the promissory estoppel claim drops out. Mr. Maguire agrees that, yes, it becomes moot. Court' further comments s Mr. Maguire agrees with the Court that if there were a reversal on appeal, then it would no longer be moot.
