Daniel Schied, counsel of record for Plaintiff Student Marketing Group, Inc., a cashier's check in the amount of $61,280.44 endorsed payable to Student Marketing Group, Inc., together with the $72,109.54 on deposit at Colorado State Bank and Trust, N.A., being held pursuant to a Writ of Garnishment return filed in this matter that College Partnership, Inc., has stipulated should be disbursed forthwith to Plaintiff Student Marketing Group, College Partnership has satisfied the outstanding amount of the judgment entered to date with costs and interest. College Partnership has satisfied the judgment solely for the purposes of protecting itself by preventing further interest from accruing on the judgment and preventing Plaintiff from taking other actions to enforce the judgment that would have a detrimental effect on its operations.

College Partnership, by satisfying the judgment, does not waive its rights to appeal the judgment and intends to continue to pursue its appeal to the Tenth Circuit Court of Appeals. DATED this 19th day of October, 2005.
