MOTION TO DISMISS WRIT OF GARNISHMENT

Plaintiff, United States of America, by its undersigned attorneys, moves this Court for an order dismissing the writ of garnishment issued February 27, 2006 against the above-named Garnishee. As grounds therefor, Plaintiff states: 1. Judgment was entered herein on October 22, 2001 in the U.S. District Court,

District of Colorado in the amount of $524,877.00 for restitution and $200.00 for special assessment. 2. A Writ of Garnishment was issued on February 27, 2006, against Defendant's

employer, FRRS/RED DOOR DIVISION.

The garnishment should be dismissed because the defendant has entered into a

voluntary wage agreement with the U.S. Attorney's Office. WHEREFORE, Plaintiff respectfully requests that the Court dismiss the Writ of Garnishment issued against FRRS/RED DOOR DIVISION dated February 27, 2006.
