Comp P-02 INSTRUCTION NO. _____ For Plaintiff to recover from the Defendant on her claim of bad faith breach of insurance contract, you must find that the following has been proved by a preponderance of the evidence: · Defendant acted unreasonably in its handling of Plaintiffs' claim for extended PIP coverage. · Defendant either knew that its conduct or position was unreasonable or recklessly disregarded the fact that its conduct or position was unreasonable. If you find that either of these statements has not been proved, then your verdict must be for the Defendant.
