Non-Stip P-14 INSTRUCTION NO. _____ When an insurer has refused to pay benefits under a contract on a particular basis any other possible basis for refusal is waived, and the insurer's decision to deny benefits must be evaluated based on the information before the insurer at the time of that decision. Peiffer v. State Farm Mut. Auto. Ins. Co., 940 P.2d 967 (Colo. App. 1996); Colard v. American Fam. Mut. Ins. Co., 709 P.2d 11, 15 (Colo. App. 1985).
