Pursuant to Rule 26(b) of the Federal Rules of Civil Procedure and for the following reasons, the parties hereby move the Court to modify the period in which parties may serve requests for admissions and contention interrogatories. Lead Plaintiffs request that this discovery now be served between February 19, 2007 and March 19, 2007. As good cause therefore, Lead Plaintiffs state: On October 27, 2005, pursuant to an agreed upon motion, the Court ordered that the parties had to serve any requests for admissions and contention interrogatories between January 6, 2006 and February 6, 2006. On December 29, 2005, this Court extended the relevant dates to between July 7, 2006 and August 7, 2006. On February 27, 2006, Lead Plaintiffs filed a Motion for Final Approval of Class Action Settlement which settled all claims against the defendants, with the exception of defendant Joseph P. Nacchio ("Nacchio") and defendant Robert S. Woodruff ("Woodruff"). The Court held a hearing on that motion on May 19, 2006. Separately, on December 20, 2005, defendant Nacchio was indicted on 42 counts of insider trading allegedly occurring between January 2, 2001 and May 29, 2001. See United States v. Nacchio, No. 05-CR545 (EWN). The court in that case has indicated it is contemplating a trial later this year, and the United States Attorney for the District of Colorado has sought to "embargo" the civil depositions of key remaining witnesses in this action, including Nacchio and Woodruff, pending the criminal trial. The original scheduling order in this action contemplated that contention interrogatories and requests for admissions would not be served until after the close of other fact discovery. Until the "embargoed" depositions proceed, the parties believe that -1-

fact discovery will not have ended, and contention interrogatories and requests for admission will have little utility. Considering the above facts, all parties agree that a further extension of the time in which to serve requests for admissions and contention interrogatories is appropriate. Therefore, in order to reduce the burden on the parties and the Court, the parties ask that the Court modify the period for the parties to serve requests for admissions and contention interrogatories so that such discovery shall now be served between February 19, 2007 and March 19, 2007. This motion shall be without prejudice to Nacchio's right, at any time prior to the completion of the pending criminal case against him (including any appeals therein), to seek such other or further relief from discovery against him as he may believe necessary or appropriate to protect his interests.
