("Qwest") respectfully requests that this Court enter the Stipulated [Proposed] Order Extending Stay that is attached as Exhibit 1 to this motion. As good grounds therefore, Qwest states as follows: 1. This Court previously ordered Qwest to produce certain documents
subject to Qwest's claim of privilege. See February 2, 2006 Order Concerning Qwest's Renewed Motion to Reconsider & To Certify Interlocutory Appeal (Docket # 923) ("February 2, 2006 Order"). 2. This Court subsequently stayed Qwest's production obligations under the
February 2, 2006 Order pending resolution of Qwest's petition for writ of mandamus filed with the United States Court of Appeals for the Tenth Circuit ("Mandamus Petition"). See March 10, 2006 Order Staying Production Of Documents (Docket # 950) ("March 10, 2006 Order").

On June 19, 2006, the Tenth Circuit denied Qwest's Mandamus Petition.
See In re Qwest Communications International Inc. Securities Litigation (App. No. 061070 June 19, 2006) ("Mandamus Decision").1 4. Qwest intends to file a petition for writ of certiorari in the United States
Supreme Court, seeking review of the Tenth Circuit's Mandamus Decision. 5. The parties have agreed to stay Qwest's production obligations under this
Court's March 10, 2006 Order pending disposition of a petition for writ of certiorari that Qwest intends to file in the United States Supreme Court.2 WHEREFORE, Qwest respectfully requests that this Court enter the Stipulated [Proposed] Order Extending Stay attached hereto as Exhibit 1.

The Tenth Circuit's Mandamus Decision was filed in this Court on June 19, 2006. See USCA Order (Docket No. 1030). Pursuant to D.C.COLO.LCivR. 7.1(A), undersigned counsel for Qwest certify that they have conferred with Lead Counsel for Lead Plaintiffs. Lead Counsel advises that, while they have agreed to stipulate to the stay and therefore do not oppose this motion, they reserve the right to revisit this issue in light of their continued litigation against the nonsettling defendants. 2
