In order to avoid burdening the Court with duplicative and lengthy filings, Defendant James A. Smith ("Smith"), through undersigned counsel, hereby joins in and adopts the Opposition to Lead Plaintiffs' Motion for Class Certification submitted by Defendant Qwest Communications International Inc. ("Qwest") which address the serious deficiencies in Lead Plaintiffs' request for class certification. For the reasons articulated by Qwest, Smith respectfully requests this Court to deny Lead Plaintiffs' Motion for Class Certification. Respectfully submitted this 30th day of June, 2005.
