Plaintiff Stichting Pensioenfonds, ABP ("ABP") submits this Motion For Leave To File Document Under Seal. The grounds for this motion are as follows: 1. Plaintff hereby requests leave to file the following document under seal:

Memorandum of Law in Support of Plaintiff's Motion to Have the Deposition of Jack Grubman Taken in the WorldCom Litigation Deemed Produced (hereafter, the "Memo for Production") 2. Plaintiff seeks leave to file the Memo for Production under seal because it

contains reference to information that has been designated as "Confidential" by Defendants Citigroup, Inc., Citigroup Global Markets, Inc., Citigroup Global Market Holdings, Inc., and Jack B. Grubman (the "Citigroup Defendants"). 3. Plaintiff does not believe that the information referenced in the Memo for

Production, in fact, qualifies for "Confidential" treatment. Nevertheless, based on the designation by the Citigroup Defendants, Plaintiff deems it necessary to file the Memo for Production under seal in compliance with the Court's Order Providing for Coordinated Discovery with Parallel Qwest Litigation, dated January 27, 2005, filed in In re Qwest Comms. Int'l. Sec. Litig., Civil Case No. 01-cv-01451-REB-CBS, and the consolidated actions.
