Plaintiff's counsel advises the Court that the parties have reached a settlement. Defense counsel Montgomery advises that the bank, the trust, C.V.Y., Corporation and Johnny on the Spot have reached a settlement of the primary claims of the bank and the trust against C.V.Y. and Johnny on the Spot. Oral Stipulated Motion for Dismissal made by counsel for defendants. ORDER: The Court grants the oral motion of the parties in which they represent that a settlement has been reached by and among Bank One, Bank One Trust Company, C.V.Y. Corporation d/b/a Your Valet Cleaners and Johnny on the Spot Inc., dismissing all claims among these parties but reserving jurisdiction to consider a motion for court approval of settlement agreement with contribution protection. Said motion will be filed within 15 days of today's date and the dismissal order the Court now enters orally will be stayed for 15 days from today's date. The trial scheduled to begin on September 4, 2007 is VACATED. Court in recess.
