PLAINTIFFS' DESIGNATIONS OF DEPOSITION TESTIMONY

Pursuant to Federal Rule of Civil Procedure 26(a)(3), Plaintiffs Bank One, Colorado, N.A. and Bank One Trust Company, N.A. (collectively, "Plaintiffs"), respectfully submit the following Designations Of Deposition Testimony in advance of trial, set to commence on September 4, 2007. The designations are contained in a table, attached as Exhibit A. 1. The deposition testimony of Harvey Luckett, who is deceased, will be offered at

trial under Rule 32(a)(3)(A). This testimony will be offered by video, in accordance with this Court's Civil Practice Standards. See MSK Practice Standards (Civil) IV.G.2. Because Plaintiffs' designations of Mr. Luckett's deposition fully encompass Defendants' designations, it is anticipated that a single video of this deposition will be offered at trial. 2. The deposition testimony of Jack Hempstead, if he is unable to attend the trial,

will be offered under Rule 32(a)(3)(C), also by video and in accordance with MSK Practice Standards (Civil) IV.G.2. 3. The deposition testimony of Mr. Martinez and Ms. Duran, if offered at trial, will

be read in accordance with MSK Practice Standards (Civil) IV.G.3.
