DEFENDANT PRATT & WHITNEY CANADA'S OBJECTIONS TO DEPOSITION TESTIMONY CROSS DESIGNATED BY PLAINTIFFS

Defendant Pratt & Whitney Canada, Inc. (PWC) hereby submits its objections to deposition testimony to the deposition testimony of Arinori Yamagata, Haruko Kikukawa, and Katsuyoshi Ida cross designated by plaintiffs. Defendant's objections to the testimony cross designated by plaintiffs in all three of these depositions are primarily based on the fact the personal injury cases separately filed by all three Japanese witnesses have been settled and dismissed and there is no issue in this case relating to the testimony to which defendant objects. The Rule 403 objection is made on the same basis and on the further basis that the testimony to

which defendant Pratt & Whitney objects is unduly prejudicial to the defendants, may confuse or mislead the jury regarding those issues in this case which are relevant, and constitutes a waste of time for the court and jury. 1.
