167. This witness has no personal knowledge of any facts other than the ownership and lease of the subject airplane, and those facts are immaterial to any issues in this trial. The probative value of this deposition testimony is substantially outweighed by the risk of unfair prejudice, confusion of the issues, misleading the jury, undue delay and waste of time.

Chester Waite (May 10, 2005) A. Plaintiffs object to all of the excerpts designated by the defendants in Doc.

167. In Doc. 88, this Court held that it could not conclude as a matter of law that this flight should have been conducted under Part 135. The deposition testimony from this witness is irrelevant until such time as the defendants meet their burden of proving that this flight should have been conducted under Part 135. Until that burden has been met, evidence of alleged violations of Part 135 are irrelevant and immaterial. The probative value of this deposition testimony is substantially outweighed by the risk of unfair prejudice, confusion of the issues, misleading the jury, undue delay and waste of time.
