PLAINTIFFS' REQUEST TO RE-OPEN ADMINISTRATIVELY CLOSED CASE FOR PURPOSE OF ACCEPTING VOLUNTARY DISMISSAL BY PLAINTIFF

Plaintiffs UnitedGlobalCom, Inc., et al, ask that the Court re-open this administratively closed matter for purpose of accepting Plaintiffs' voluntary dismissal pursuant to F.R.C.P. 41(a), which is also filed today. As a basis therefore, Plaintiffs state that this matter was administratively closed by order of the Court on September 2, 2003, because of a pending matter in the Industrial Relations Commission of New South Wales, Australia. In its order closing the case, the Court stated that the "parties will not be required to file status reports in this matter but may elect to re-open the case at any time . . ." Order of Sept. 2. 2003 at 27. Wherefore, Plaintiffs request that the Court reopen the case, for the purpose of accepting the Notice of Dismissal filed by the Plaintiffs today.
