Discussion regarding issues related to the penalty phase and time limits for opening statements. Government shall file revised exhibit and witness lists by Friday, March 16, 2007, at 12:00 noon. Government shall keep some sort of accurate record of what was received from the defendant's witnesses in advance of the penalty phase and information learned for the first time through testimony. Opening statements shall not exceed forty-five (45) minutes per side. Discussion regarding number of witnesses to be called and exhibits to be used during penalty phase. Discussion regarding case law regarding life imprisonment being imposed if a unanimous verdict cannot be reached by the jury.
