GOVERNMENT'S UNOPPOSED MOTION FOR TWO-WEEK CONTINUANCE OF STATUS HEARING

The United States of America, by Troy A. Eid, United States Attorney for the District of Colorado, and through Brenda K. Taylor and Philip A. Brimmer, Assistant U.S. Attorneys, respectfully requests that the Court continue the status hearing currently set for 4:00 p.m. on Thursday, August 23, 2007 for a two week period. The reasons for this request are as follows: 1. The Court has directed the Government to determine whether it will continue to seek the death penalty in the murder prosecution of Rudy Sablan by the time of the status hearing set for August 23, 2007. 2. As the Court is aware, the final decision in this matter lies with the Attorney General of the United States. 3. The Capital Case Unit of the Criminal Division of the Department of Justice has

completed its review and its recommendation in this matter has been forwarded this date to the Office of the Deputy Attorney General for a final decision. Consideration by the Deputy Attorney General and the Attorney General is the concluding step in the process. 4. The Deputy Attorney General requires two additional weeks, until September 6, 2007, to complete the required internal process. The United States Attorney's Office has been assured that a final decision will be made by that date. 5. Counsel for Defendant Rudy Sablan, Forrest W. Lewis, has been contacted by undersigned counsel, and he has no objection to the government's request.
