DANIEL A status conference is set for Thursday, May 24, 2007, at 11:30 a.m. The parties shall file a status report on or before Monday, May 21, 2007, indicating (1) what motions are pending that need to be ruled on and whether any pending motions are moot; (2) whether additional motions will be filed and the suggested timing for filing those motions; (3) what additional issues need to be briefed and/or heard by the Court, including Phase III evidentiary challenges in regard to the Government' Proffer and s Amended Proffer of Penalty Phase Evidence in Support of Non-Statutory Aggravating Factor of Future Dangerousness of Rudy Sablan, and the suggested timing for same; (4) trial scheduling issues, including the likely length of the trial and suggested trial dates on or after January 1, 2008; (5) confirmation by the Government that it intends to seek the death penalty against this defendant in light of the result in the trial involving William Sablan; and (6) any other issues the parties believe are appropriate to address at this time.
