JOINT FILING PURSUANT TO DECEMBER 19, 2003 ORDER MEMORIALIZING HEARING By Order of December 19, 2003, the Court ordered the parties to supplement the record by filing documentation relating to the "origin" of the term "separative work unit" and gave them

permission, if they so desire, also to file supplemental briefs. The parties hereby jointly respond to that order. We attach four documents as exhibits. The first exhibit is from the Federal Register of December 23, 1966, 31 FR 16479-81, entitled Atomic Energy Commission Uranium Enrichment Services. In the first paragraph, it defines the term "separative work"; in

"enrichment services," and, at note 1,

paragraph numbered 5, it states that the amount of enrichment services is to be "define[d] ... in terms of units of separative work" as related in a "standard table of enrichment services." We

believe this document is the origin of the term separative work

unit.

The enrichment criteria set forth in this document were

later revised: the second exhibit is 10 CFR Part 762 (1992) which was the final revision of those criteria. The third exhibit is from the Federal Register of November 29, 1967, 32 FR 16289-91. It first set forth the standard table of

enrichment services and the charge per unit of separative work. The fourth exhibit is from the Federal Register of March 9, 1971, 36 FR 4563. It was, we believe, the final published revision of

the standard table of enrichment services that went into effect. The United States Enrichment Corporation's web site includes a page entitled "What is a SWU?" consideration of this web page. No party objects to the Court's It may be accessed at:
