SCHEDULING ORDER On June 10, 2005, the Federal Circuit reversed a previous decision of this court and remanded the case with instructions that the plaintiff recover the tax assessment with interest. See PSI Energy, Inc. v. United States, 411 F.3d 1347 (Fed. Cir. 2005). In accordance with that decision, the parties are hereby ORDERED to meet and confer to discuss the implications of the Federal Circuit's decision and the feasibility of settlement negotiations in this case.

The parties shall file a Joint Status Report no later than December 16, 2005, advising this court of the progress of any settlement negotiations and proposing a procedural framework for this court to resolve this dispute. IT IS SO ORDERED.
