ORDER MEMORIALIZING HEARING On December 18, 2003, the court heard oral argument regarding Defendant's Motion to Dismiss. Upon agreement of all parties that the court should deem the motion as one for Summary Judgment pursuant to Rule of the Court of Federal Claims 56, the court directs the parties to supplement the record by filing any documentation relating to the origin of the term "separative work unit" as contained in EPACT, 42 U.S.C. ยง 2297g-1(c). The parties may also file supplemental briefs if they so desire, up to 5 pages, indicating the effect this definition has on the case. All documentation supplementing the record and any supplemental briefs must be filed by January 15, 2004.
