Pursuant to the court's Opinion, filed July 17, 2007, granting in part, and denying in part, plaintiffs' motion for summary judgment, and granting in part, and denying in part, defendant's partial cross motion for summary judgment, and the court's Order filed April 11, 2008, granting the parties' joint motion for entry of judgment, IT IS ORDERED AND ADJUDGED this date, pursuant to Rule 58, that the claims involving the 1999 federal income tax liability are dismissed, as are the claims involving the year 2000 federal income tax liability.
