In its motion, defendant requests an enlargement of fourteen (14) days, through and including May 15, 2008, within which to file a reply brief in support of its motion for judgment upon the administrative record. Defendant indicates that its reply is currently due May 1, 2008; however, the docket indicates that its response to plaintiff's cross-motion is due by May 15, 2008.1 As such, defendant's motion seeking an extension of time through and including May 15, 2008, is unnecessary. Accordingly, defendant's motion is DENIED AS MOOT because May 15, 2008, is the due date for defendant to respond to plaintiff's cross-motion. IT IS SO ORDERED.

Defendant filed its cross-motion for judgment upon the administrative record and a response to plaintiff's motion to remand on February 27, 2008. The deadline for plaintiff's response, which was originally due March 31, 2008, was extended to April 14, 2008, by Order dated March 25, 2008. On April 14, 2008, plaintiff filed a cross-motion for judgment upon the administrative record and opposition to defendant's motions to dismiss and for judgment upon the administrative record. The docket indicates that defendant's response to plaintiff's April 14, 2008 filing is due on May 15, 2008.
