As was discussed, the Court had anticipated that the December 28, 2007 deadline for additional written discovery (included in the December 14, 2007 Order) would have enabled plaintiffs to receive responses to their discovery requests in time to use the responses in preparing for the deposition scheduled for January 25, 2008. Because this turned out not to be the case, the Court GRANTS plaintiffs' request to reschedule the Rule 30(b)(6) deposition, which shall now be taken on Friday, March 7, 2008. The parties are strongly encouraged to resolve their differences concerning production of defendant's Excel spreadsheet and its embedded formulae prior to the date of the deposition. As was provided in the December 14, 2007 Order, the plaintiffs will have ten days from the date of receipt of the deposition transcript in which to determine if they will seek leave to conduct additional discovery based on information learned during the deposition. If the plaintiffs feel that additional discovery is necessary, their counsel shall promptly discuss this matter with government counsel to determine if the government would consent to the additional discovery. The plaintiffs shall only file a motion for leave with the Court if this consent has been sought and denied. The parties shall file a joint status report on or before March 28, 2008 with a proposed schedule for further proceedings, consistent with the process detailed in the June 12, 2007 order.
