DELPIN APONTE et al., * * Plaintiffs, * * v. * * THE UNITED STATES, * * Defendant. * * *********************** ORDER The Court has scheduled a telephone conference for Thursday, December 13, 2007 at 10 a.m. EST to discuss plaintiffs' motion, filed November 19, 2007 and opposed December 5, 2007, concerning the difficulties in finding a mutually-agreeable time to conduct a certain deposition. The Joint Status Report of June 14, 2007 had indicated that the deposition would take place on or before August 22, 2007 -- a date which according to defendant's Status Report of October 12, 2007 was delayed by mutual agreement to November 1, 2007. Upon learning that the deposition had not yet occurred, the Court on October 19, 2007 ordered the deposition to take place on or before November 16, 2007. Given this frustrating procedural background, and recognizing the possibility that the Court will order the deposition for a date certain, counsel are requested to have available at this conference not only their own schedules, but also the schedules (through January 2008) of the additional persons who would be required to attend the deposition in question (i.e., plaintiffs' expert witness Dr. Jaime del Valle and United States Postal Service designated representative Jo Ann Mitchell). IT IS SO ORDERED.
