DELPIN APONTE, * * Plaintiffs, * * v. * * THE UNITED STATES, * * Defendant. * * *********************** ORDER The Court has reviewed plaintiffs' motion for leave to file a motion concerning the scheduling of a deposition, filed November 19, 2007. Plaintiffs apparently attempted to file the underlying motion on November 16, 2007. A brief power outage apparently hindered the electronic filing, and the failure to file the motion was not discovered by counsel until the 19th. The Court GRANTS plaintiffs' motion for leave, and accordingly allows the motion concerning the deposition to be filed. Per telephone call with Chambers, defendant's counsel has indicated its intent to oppose plaintiff's scheduling motion. Defendant shall therefore have the usual time to respond as provided in Rule 7.2(a) of the Rules of the Court of Federal Claims, with November 19, 2007 being considered the date of service of plaintiffs' motion. IT IS SO ORDERED.
