Defendant contends that Plaintiff's motion for partial summary judgment on its equitable adjustment claim is premature, prior to the close of fact discovery, because factual issues may exist upon which discovery is necessary. For good cause shown, Defendant's motion is GRANTED. Defendant's response to Plaintiff's motion for partial summary judgment is hereby stayed until the close of fact discovery on January 18, 2008.
