ORDER The court is in receipt of the parties' joint motion to stay proceedings to facilitate settlement discussions. The motion to stay the proceedings is denied. However, because the court encourages settlement, the briefing schedule for cross-motions for partial summary judgment in the court's Order of May 23, 2008, is suspended until further notice. On or before Monday, July 14, 2008, the parties shall file a joint status report, reflecting their settlement progress, but without any numbers. If settlement is not viable, the parties shall propose in the July 14, 2008 joint status report a briefing schedule for resumption of their cross-motions for partial summary judgment.
