DEFENDANT'S STATUS REPORT Pursuant to this Court's April 19, 2007 order, defendant, the United States, respectfully submit this status report informing the Court of progress made towards settlement. On August 14, 2007, counsel for Riley & Ephriam reported to counsel for the United States that he had received the check sent by the Department of the Treasury, pursuant to the settlement agreement. Pursuant to the parties' settlement agreement, once Riley & Ephriam received payment, the parties were to file a joint notice of dismissal, pursuant to Rule 41 of the Rules of the Court of Federal Claims. Accordingly, on that same day, counsel for the defendant forwarded to Riley & Ephriam's counsel, for his signature, a Joint Notice of Dismissal.

On August 20, counsel for the defendant attempted to contact Riley & Ephriam's counsel, but was informed that he would be out of the office the week of August 20-24. Counsel for the defendant believes that once all signatures have been obtained, the Joint Notice of Dismissal will be filed expeditiously with this Court. Respectfully Submitted, PETER D.
