DEFENDANT'S STATUS REPORT Pursuant to this Court's order, defendant, the United States, respectfully submits this status report informing the Court of progress made towards settlement. Counsel for the defendant provided the contents of this status report to plaintiff's counsel, who was unavailable to review and sign the report. On June 20, 2007, Nancy Burch, a paralegal at Smith, Cooksey & Vickstrom, stated to undersigned counsel that the plaintiff consented to the defendant's filing of this report. Since the parties filed the last status report, the parties have reached and signed a settlement agreement. Counsel for the defendant has initiated the preparation of paperwork necessary for judgment to paid from the Treasury Department's Judgment Fund.

Once that paperwork has been finalized and approved, it will be sent to the Treasury Department for payment.
