AFFIDAVIT OF HOLLY L. CINI IN SUPPORT OF DEFENDANT'S MOTION TO COMPEL

HOLLY L. CINI, being duly sworn, deposes and states as follows: 1. 2. I am over the age of 18 and understand the obligations of an oath. I am an attorney with the law firm of Jackson Lewis, LLP and represent the defendant, Shaw's Supermarkets, Inc. in the above-captioned matter. I submit this Affidavit in support of Defendant's Motion to Compel, dated February 27, 2004. Defendant has attempted in good faith to resolve the current discovery dispute between the parties without the intervention of the court. On February 24, 2004, I spoke with John Williams, counsel for the plaintiff, and we agreed to resolve the dispute with the entry of a Court order to compel the plaintiff's appearance at his deposition on March 18, 2004.
