DEFENDANT GUIDEWIRE SOFTWARE, INC.’S COUNTERCLAIMS V, VI, AND VII
_ Plaintiff Accenture Global Services GmbH and Accenture LLP (collectively
"Accenture”) hereby moves the Court pursuant to Federal Rule of Civil Procedure l2(b)(6) for
an Order dismissing the Fifth, Sixth, and Seventh counterclaims in Guidewire Software, incfs
(Guidewire°s) Answer and Counterclaims, or in the alternative, bifurcate and stay such
counterclaims pending the resolution of Guidewire’s inequitable conduct counterclaim.
i Specifically, Accenture moves to dismiss the Fiith, Sixth, and Seventh counterclaims on the
` ground that they fail to state a claim upon which relief can be granted. Moreover, bifurcating
these counterclaims will minimize unncessary discovery as well as privilege problems that result
I from sirnultaneousiy litigating a claim that assumes that Accenture’s infringement action has
- already been rejected.
The grounds for this motion are more fuily set forth in Accenture’s Opening Brief, filed
herewith.
