reference, as if set forth herein in fuli, Defendants Leica Camera AG and Leica Camera, `
Inc.’s Motion to Dismiss or, in the Alternative, for a More DefInite Statement (DI. 76).
Any factual arguments in that motion relating to Leica Camera AG and Leica Camera,
Inc. are equally true regarding VuPoint (nameiy paragraph 64 ofthe Compiaint, D.I. 1).
For the reasons set forth in Defendants Leica Camera AG and Leica Camera,
Inc.’s Motion to Dismiss or, in the Alternative, for a More Definite Statement (DJ. 76),
VuPoint respectfuliy requests the Court to dismiss the Complaint as to VuPoint under
