Upon motion of the defendant and good cause appearing, IT IS HEREBY ORDERED that the defendant's Motion to Continue Trial and Pretrial Motion Filing Deadline is granted pursuant to 18 U.S.C. §3161 (h)(8)(A). This court specifically finds that the ends of justice served by granting a continuance outweigh the best interest of the public and the defendant in a speedy trial. This finding is based on the court's conclusion that the failure to grant such a continuance would unreasonably deny the defendant the reasonable time necessary for effective preparation, taking into account the exercise of due diligence. 18 U.S.C. §3161 (h)(8)(b)(IV). IT IS FURTHER ORDERED continuing the trial of this case from September 6, 2005 to October 4, 2005 at 8:30 a.m., in Phoenix, Arizona. IT IS FURTHER ORDERED extending the current pretrial motions deadline to September 1, 2005.
