15 America, by and through undersigned counsel, hereby moves this Court for an order dismissing 16 the Indictment against defendant, Timmons Carpenter, without prejudice. The defendant has 17 been a fugitive since his escape from Behavioral Systems Southwest on April 27, 2001, and it 18 is believed that the interests of justice will best be served by this dismissal. 19 20 The government further requests the warrant in this matter be quashed. Excludable delay under 18 U.S.C. § 3161 will not occur as a result of this motion or an order
