Transcripts and Status
Dear Steve:
I enclose a copy ofthe transcripts of Verdugo’s testimony dated November 27. 2002. and
December 3, 2002. The Campbell transcript(s) have not yet been provided to me. I am still missing
Day 2 ofthe trial. I assume that Day l includes the jury selection and opening statements only. I
will check with the court reporter to determine when I can expect the remainder of the trial
transcripts.
As I told you, the opening statements and closing arguments will be ordered for the appeal
once you are sentenced.
I am in receipt of your letter dated July 7, 2003. I suggest that it would be to your benefit to
have counsel present for these meetings. At least there will be a witness present as to what is really
said.
I will contact the prosecutor and request a copy of your statement. I need to research the
grand jtuy issue.
I intend to ask for another continuance of your sentencing date——currently set for July `l7,
2003. I believe that I need to review the trial transcripts in order to adequately represent you at
sentencing. There may be a basis to argue that you are entitled to a senterece less than the statutory
mira mum of l0 years. Additionally, I believe thatl should try and see if"Lucy" will cooperate when
and i1` she returns to Arizona. _
At this point, I think that time is on your side.

2 MR. RYAN: Thank you, Your Honor, I have received
3 information that possibly one of the prosecutors, as we
4 discussed in part in the —- in chambers, had discussions with
5 jurors about pending investigation against Mr. Dobson’s
6 co-defendant Mr. Martin; allegations that a prosecutor
7 discussed the fact that there was an investigation against
B Mr. Martin for murder.
9 I have also received‘information that the Court itself
10 has had discussions with reporters in Tennessee about this
11 case. Furthermore, Mr. Dobson, as the Court is aware, has
12 filed a bar complaint against me. Ilfeel constrained at this
13 point, Your Honor, to move to withdraw, even for the purposes
14 of sentencing, as there is an apparent conflict of interest
15 between Mr. Dobson and I. A I
16 THE COURT:, Mr. Dobson, you have heard your lawyer
17 seek to withdraw as counsel for you. Do you have any
18 objection to your lawyer withdrawing and to the court
19 appointing a new lawyer for you?
20 STEVE DOBSON; No, sir.
21 THE COURT: You have no objection?
22 STEVE DOBSON: No, sir. ·
