The United States of America, through its undersigned attorneys, hereby moves this court pursuant to Local Rule of Criminal Procedure 5.3 and Local Rule of Civil Procedure 42.1, for an order reassigning to a single judge the three above captioned matters, each of which is now

pending before a different judge, on the grounds that each matter arises from substantially the same transactions or events. The defendant was arrested on December 7, 2006 for the offense of Possession of Stolen Mail, in violation of Title 18, Unites States Code §1708, and subsequently indicted for that offense in CR-06-1160-PHX-PGR. The same allegation serves as the basis for the petitions seeking a revocation of his supervised release in CR-00230-PHX-MHM and CR-02-1216-PHXRGS. Pursuant to Local Civil Rule 42.1(a)(4), Judge Murguia should be assigned all three matters as she is already assigned to a case with which she has prior familiarity. Excludable delay under Title 18, U.S.C. §3161(h)(1)(F) and (j) and §3161(h)(3)(A) and (B) will occur as a result of this motion and any order based thereon.
