Petition to Revoke Probation T
COMES NOW PROBATION OFFICER David J. Gardner presenting an official report on Leilani
Keoke who was placed on probation on December 16, 2002 bythe Honorable Roslyn O. Silver presiding
in the District Court of Arizona. A three year period of probation was imposed. In addition to the general
terms and conditions adopted by the court in General Order 04-1 1, the offender was ordered to comply
with the following special conditions:
1. You shall participate as instructed by the probation officer in a program of substance abuse
treatment which may include testing for substance abuse. You shall contribute to the cost of
treatment in an amount to be determined by the probation officer.
2. You shall submit your person, property (including but not limited to computer, electronic devices,
and storage media), residence, office, or vehicle to a search conducted by a probation officer, at
a reasonable time and in a reasonable manner.
3. You shall provide the probation officer access to any requested financial information.
4. You are prohibited from owning, maintaining or using a firearm.
5. You shall abstain from all use of alcohol or alcoholic beverages
6. You shall not have contact with the co-defendants of this case unless approved by the probation

Leilani Keoke was convicted of possession of a controlled substance, a Class A misdemeanor offense.
RESPECTFULLY PRESENTING PETITION FOR ACTION OF COURT FOR CAUSE
AS FOLLOWS:
A. Violation of Standard Condition #8: "You shall refrain from excessive use of alcohol and shall not
purchase, possess, use, distribute or administer any narcotic or other controlled substance, or any
paraphernalia related to such substances, except as a prescribed by a physician. Possession of
controlled substances will result in mandatory revocation of your term of supervision. If ordered by the
Court to participate in a drug and/or alcohol treatment program, you shall totally abstain from the use of
any alcoholic beverages or other intoxicants during and after the course of your treatment.

Allegationz The offender used methamphetamine on or about October 24, 2005, as confirmed by the
laboratory testing results contained in the attached drug test report. A Grade C violation. ?7B1.1(a)(3).

B. Violation of Standard Condition #16: "Any financial obligation ordered by this Court shall be paid
in regular monthly installments approved bythe probation officer, the full amount to be paid 90 days prior
to expiration of supervision. You will notifythe probation officer of any material change in your economic
circumstances that might affect your ability to pay restitution, fines, or special assessments."
Allegation: The offender has not paid a fine in the amount of $500.00 as ordered by the Court. The
offender was directed and agreed to pay the $175.00 balance by November 1, 2005; however, the
balance has not been paid to date. The offenders last payment was made on September 15, 2004, as
evidenced by the attached payment record. A Grade C violation. §7B1.1(a)(3).
C. Violation of Special Condition #1: "You shall participate as instructed by the probation officer in a
program of substance abuse treatment which may include testing for substance abuse. You shall
contribute to the cost of treatment in an amount to be determined by the probation officer." A
Allegationz The offender has not participated in weekly substance abuse treatment at Horizon Human
Services, Globe, Arizona, as directed. Her poor attendance record is evidenced by the monthly reports
submitted by the treatment provider. A Grade C violation. §7B1.1(a)(3).
AFFIDAVIT AND PETITION PRAYING THAT THE COURT WILL ORDER A WARRANT BE ISSUED
In conformance with the provision of 28 U.S.C. § 1746, I declare, under penalty of perjury, that the
foregoing is true and correct to the best of my knowledge. Based on the information presented that the
offe der has violated conditions of supervision, I am petitioning the Court to issue a warrant.
